What Are the Violations of Georgia’s DUI Laws?

 

The Georgia Driver’s Manual and Chapter 40 of the Georgia Criminal Code outline what constitutes traffic offenses.

Common examples of these include:

  • Driving without a license

  • Driving without insurance

  • Speeding and Super Speeder violations

  • Seat belt violations

  • Reckless driving

  • Leaving the scene of an accident

  • Distracted driving/texting

  • Hit and run


Some of the offenses listed, such as driving without a seatbelt, are considered minor and typically result in citations that can either be paid immediately or contested in traffic court.

However, driving without a license, reckless driving, or leaving the scene are serious criminal accusations that can result in jail time and/or fines. In Georgia, reckless driving and leaving the scene of an accident can result in jail time of up to a year and fines of up to $1,000. Under Georgia law, a conviction for any serious traffic offense can also result in mandatory revocation of your license, and often for an extended time period.

Georgia’s Point System

 

Georgia uses a “point system” in which points accrue to your driving record if you are convicted of an offense. These points affect the validity of your driver’s license. Both age and how many points you’ve received in the past contribute to the effect these points have on your license.

Here are some examples of point values for the most common offenses:

  • Aggressive driving — 6 points

  • Reckless driving — 4 points

  • Unlawful passing of a school bus — 6 points

  • Speeding 15-18 miles over the limit — 2 points

  • Speeding 19-23 miles over the speed limit — 3 points

  • Speeding 24-33 miles over the speed limit — 4 points

  • Speeding 34 or more miles over the speed limit — 6 points

  • Improper passing on a hill or curve — 4 points
